SumDuel

Terms of Use

Last updated: 8 October 2026 · Applies to the SumDuel website (sumduel.site) and the SumDuel iPhone/iPad and Android apps (together, the "Service").

The short version

1. Agreeing to these Terms

By creating an account, continuing as a guest, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use SumDuel. The Service is run by Ansh Panchal, an individual based in the United Kingdom ("we", "us").

2. Who can use SumDuel

You must be at least 13 years old. If you live somewhere that requires a higher age to agree to a service like this, you need a parent or guardian's permission. You must be able to form a binding agreement and must not be barred from using the Service by law. We may ask you to confirm your age and may remove accounts we believe belong to someone under 13.

3. Your account

4. Fair play and conduct

You agree not to:

5. Your content

"Your content" means things you create in SumDuel, such as question sets, nicknames and room names. You keep ownership of your content. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy and display it, and to show it to the players in rooms you host or share it with, only as needed to run and improve the Service. This licence ends when you delete the content or your account, apart from short-lived backups.

You promise that you have the right to use your content and that it doesn't break the law or anyone's rights. Don't upload copyrighted material you don't have permission to use, such as pages copied from a textbook or exam. We may remove content that breaks these Terms.

6. Hosts and classrooms

If you host a live room (for example as a teacher), you are responsible for who you invite and what you run in it. You must make sure every participant is old enough to use SumDuel, that you have any permission your school or local law requires, and that participants use nicknames that don't identify them. Hosts must use participant results (reports and CSV downloads) lawfully and only for teaching and learning purposes.

7. Safety, reports and moderation

Players can block and report others from inside the app. We review reports and may warn, remove content, restrict features, or suspend or delete accounts that break these Terms, with or without notice where the problem is serious. We are not obliged to monitor the Service, but we may act on anything we become aware of. If you think we got it wrong, email us and we will take another look.

8. Our rights

The Service, including its software, design, game rules, questions we generate, artwork, branding and the name SumDuel, belongs to us or our licensors and is protected by law. We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service as intended. We welcome feedback and may use it without owing you anything.

9. The Service

SumDuel is provided free of charge and "as is" and "as available". We work hard to keep it running, but it may be interrupted, contain bugs, or change. Real-time games depend on your internet connection and a game in progress can be lost if the server restarts or you disconnect. We may add, change, limit or stop features, ratings, leaderboards and events at any time. Ratings, XP, badges and cosmetic items have no cash value and aren't property.

10. App stores

If you get the app from the Apple App Store or Google Play, these Terms are between you and us, not Apple or Google. Apple and Google have no obligation to provide support or maintenance for the app and are not responsible for it or for claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms for the iOS app and may enforce them against you. You must also follow the store's own terms of service.

11. Liability

Nothing in these Terms limits or excludes liability that can't legally be limited, including for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any rights you have as a consumer that cannot be waived.

Subject to that, and because SumDuel is provided free: (a) we are not liable for loss or damage that is not a foreseeable result of our breach, for business, profit or data loss, or for indirect or consequential loss; and (b) our total liability to you for anything connected with the Service is limited to £100. We are not responsible for problems caused by things outside our reasonable control, such as internet or hosting outages, device problems, or other users' behaviour.

You agree to be responsible for losses we suffer because you broke these Terms or the law.

12. Ending your use

You can stop using SumDuel at any time and can delete your account yourself (Profile → Delete account in the app, or the sidebar on the website). We may suspend or end your access if you break these Terms, if we must by law, or if we stop running the Service, in which case we will try to give reasonable notice. Sections that by their nature should continue (such as 5, 8, 11 and 13) survive ending.

13. Governing law

These Terms and any dispute about them are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in your local courts.

14. Changes

We may update these Terms, for example when we add features or the law changes. We will change the date above and, for material changes, tell you in the app or by email before they take effect. If you keep using SumDuel after that, you accept the updated Terms. If you don't agree, you can delete your account.
